Acceptance of Terms
The Terms and Conditions of Service are provided to the client with each quote issued by Ore Grade Petrology. Acceptance of a quote constitutes formal acceptance of, and agreement to be bound by, these Terms and Conditions.
Fees and Taxes
All prices quoted by Ore Grade Petrology are exclusive of GST or any other applicable value-added taxes, unless expressly stated otherwise.
Confidentiality
Neither Ore Grade Petrology nor the client shall disclose any confidential information of the other party to any third party without prior written consent, except where disclosure is required by law or by the rules of a relevant stock exchange.
Samples and Materials
The client acknowledges that, in the course of performing the services, any sample supplied by or on behalf of the client may be altered, consumed, lost, damaged, or destroyed. Ore Grade Petrology accepts no liability whatsoever to the client or any third party for any samples so altered, lost, damaged, or destroyed.
Nature and Limitations of Services
The client acknowledges that it is solely responsible for assessing the suitability of the services for any particular purpose, including consideration of detection limits, confidence intervals, and methodological limitations inherent in Ore Grade Petrology’s analytical techniques, reports, and interpretations.
Ore Grade Petrology does not warrant or guarantee:
the success or outcome of any individual analysis;
the precision or accuracy achievable by any analytical method; or
hat the results obtained will be meaningful or commercially successful for the client’s intended purpose.
The client acknowledges that payment is made solely for the performance of the agreed analyses and associated data processing.
Analytical Scope and Methodology
The number and type of analyses to be performed are defined in the accepted quote. Information relating to data reduction procedures, analytical instrumentation, and reference standards will be provided upon reasonable request.
Ownership of Data
All data generated by Ore Grade Petrology in connection with the services remains the property of Ore Grade Petrology until full payment of all invoiced amounts has been received. Upon receipt of full payment, ownership of the data shall transfer to the client.
Timeframes and Delays
Any timeframe provided for completion of the services is indicative only and may be subject to change due to unforeseen circumstances. Delays may occur as a result of equipment malfunction, breakdown, or other factors beyond Ore Grade Petrology’s control. Ore Grade Petrology accepts no responsibility for such delays, and no cancellation or refund shall arise as a result.
Use and Interpretation of Data
Ore Grade Petrology accepts no responsibility or liability for any actions taken by the client or any third party arising from, or in reliance upon, interpretations of the data provided by Ore Grade Petrology.
